1. Terms & Conditions

1.1 Who we are

1.2 What these terms cover

These Terms & Conditions apply to your use of the Silly School Education website, subscription platform, videos, songs, downloadable resources, emails, free resources and any related services we provide.

By creating an account, starting a free trial, purchasing a subscription, downloading a resource or using our website, you agree to these terms.

1.3 Adult accounts only

Accounts are intended for adults, including teachers, school staff, parents, guardians, home educators and other adults using the service for educational purposes. Children must not create accounts themselves.

If children watch or use our content, this must be under the supervision and responsibility of an appropriate adult.

1.4 Educational use

Our content is designed to support education, teaching, learning and classroom use. It is not a replacement for professional teaching judgement, school safeguarding policies, curriculum planning, medical advice, specialist educational advice or any statutory responsibility held by schools, teachers, parents or guardians.

1.5 Account security

You are responsible for keeping your login details secure. You must not share your login details with anyone outside your own authorised use or licensed school/group plan. If you believe your account has been accessed without permission, please contact us as soon as possible.

1.6 Acceptable use

You must not use Silly School Education:

  • for unlawful, harmful, abusive or misleading purposes;
  • to copy, scrape, download, reproduce or redistribute our content except as allowed by these terms;
  • to share paid resources publicly or with unlicensed users;
  • to attempt to bypass payment, access controls or platform restrictions;
  • to upload or transmit viruses, malware or harmful code;
  • to interfere with the security, performance or operation of the website or platform.

1.7 Availability of the service

We aim to keep Silly School Education available and working well, but we cannot guarantee uninterrupted access. The website may occasionally be unavailable due to maintenance, updates, technical issues, third-party platform issues or circumstances outside our control.

We may update, remove, replace, reorganise or improve content at any time.

2. Subscriptions, Trials, Billing & Refunds

2.1 Free trials

We may offer a free trial, such as a 7-day trial. Trial length may vary depending on the offer available at the time you sign up.

At the end of the trial period, your subscription will automatically become a paid subscription unless you cancel before the trial ends.

By entering your payment details at sign-up, you authorise payment to be taken when your trial ends unless you cancel in time.

2.2 Subscription plans

Subscription fees, billing intervals and included access are shown at checkout. Plans may be monthly, annual, individual, group or school-based, depending on what is available at the time of purchase.

We are not currently VAT registered, so VAT is not added unless this changes in the future.

2.3 Payments

Payments are processed securely through Kajabi Payments and its payment-processing partners. We do not directly store your full payment card details.

You are responsible for ensuring your payment details are accurate and up to date. If payment fails, access may be paused, restricted or cancelled.

2.4 Renewals

Monthly subscriptions renew each month unless cancelled before renewal. Annual subscriptions renew each year unless cancelled before renewal.

Annual subscriptions are billed in full upfront.

2.5 Cancellations

You can cancel your subscription through your account settings where available, or by contacting us at [email protected].

If you cancel during a free trial, no payment should be taken, provided cancellation is completed before the trial ends.

If you cancel after a payment has been taken, your access will normally continue until the end of the billing period already paid for.

2.6 Refunds

Except where required by law, subscription payments are non-refundable. This includes monthly payments, annual payments, renewals, part-used billing periods, unused access, failure to use the service, accidental continuation after a trial, and cancellation after payment has already been taken.

Refunds may be issued at our discretion or where required by law, including where a duplicate payment has been taken in error or where a payment has been taken due to a clear technical fault.

Nothing in these terms limits any legal rights that cannot lawfully be excluded.

2.7 School and group subscriptions

School and group plans cover the number of users agreed at purchase or confirmed in writing. Access must not be shared beyond the licensed staff/users.

Group and school subscriptions are normally billed annually. Where trial access is offered for a group or school, this may be limited to one trial login rather than full access for every member of staff.

Misuse of group access, sharing logins, exceeding agreed user limits or distributing paid content outside the licensed group may result in suspension or termination of access.

3. Content, Copyright & Licence

3.1 Our content

All songs, videos, animations, graphics, characters, teaching resources, PDFs, downloads, text, lesson materials, designs, branding and other content made available through Silly School Education are owned by or licensed to Silly School Education Ltd unless stated otherwise.

3.2 What you may do

During an active subscription or authorised free access period, you may use our content for personal educational use, classroom teaching, school teaching, tutoring, home education or other reasonable educational purposes covered by your subscription or access arrangement.

You may download and use resources made available for download, provided they are used only for your own classroom, school, group, tutoring or home education use and are not shared publicly or resold.

3.3 What you may not do

You must not, without our written permission:

  • copy, reproduce, sell, resell, license, rent, publish or commercially exploit our content;
  • upload our paid resources to public websites, social media, file-sharing platforms or resource marketplaces;
  • share paid downloads with people who are not covered by your subscription or school/group licence;
  • remove branding, copyright notices or watermarks from our resources;
  • use our songs, characters, videos, animations or materials to create competing products or services;
  • record, rip, scrape, bulk download or redistribute videos or platform content;
  • use our content in any way that suggests we endorse another product, school, business, channel or organisation without permission.

3.4 Free resources

Free resources are provided for educational use only. You may use them in your own classroom, school, tutoring, home education or educational setting. You must not sell them, upload them to public resource sites, claim them as your own or use them as part of a competing paid product.

3.5 User feedback and testimonials

If you send us feedback, reviews, comments, testimonials or suggestions, you allow us to use them for business, marketing, website and service-improvement purposes. We will aim to use teacher/customer comments fairly and respectfully.

4. Liability

4.1 Educational resources

We work hard to make our content useful, accurate and suitable for educational use, but we do not guarantee that every resource will meet every curriculum, school policy, learning need or individual requirement.

Teachers, schools, parents, guardians and other responsible adults must decide whether content is appropriate for their pupils, children, setting and intended use.

4.2 No guarantee of outcomes

We do not guarantee any specific learning outcome, assessment result, school performance, pupil progress, platform result, revenue result or business outcome from using our content or service.

4.3 Limits of liability

To the fullest extent permitted by law, Silly School Education Ltd will not be liable for indirect, incidental, special or consequential loss, loss of profit, loss of business, loss of data, loss of goodwill or loss arising from misuse of the service.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.
